The Department published its Regulatory Agenda on 2994 of Issue 4 in Volume 38 of the Illinois Register on January 24, 2014.

  • NOTICE – Proposed amendments have been filed by the Department which affect Sections 240.120, 240.237 (new), 240.741 (new), 240.945, 240.1505, 240.1543 (new), 240.1544 (new), 240.1600, 240.1650, 240.1955, and 240.1957 (new) in Part 240 for the rules governing the Community Care Program under Title 89 of the Illinois Administrative Code. This rulemaking will add automated medication dispenser (AMD) service as a core service under the Community Care Program (CCP). This rulemaking project was published in the Illinois Register on page 1408 of Issue 3 in Volume 38 of the Illinois Register on January 17, 2014.

    Documents (see PDF's below) have been filed with the Joint Committee on Administrative Rules to start the Second Notice Period for this rulemaking project. The Second Notice Period began on March 28, 2014, and will end no later than May 11, 2014, unless extended. This matter will be reviewed by the Joint Committee on Administrative Rules at its upcoming meeting on April 7, 2014.

  • NOTICE – Amendments were adopted by the Department which affect Sections 240.1530 and 240.1531 (new) in Part 240 of the rules governing the Community Care Program under Title 89 of the Illinois Administrative Code on February 21, 2014. These rules relate to electronic visit verification requirements for in-home service providers. This rulemaking project was published in the Illinois Register on page 5800 in Volume 38 on March 7, 2014.

      NOTICE – Emergency amendments have been adopted by the Department which affect Sections 270.10, 270.200, 270.205, 270.210, 270.215, 270.220, 270.225, 270.230, 270.235, 270.240, 270.241 (new), 270.245, 270.250, 270.255, 270.260, 270.265, 270.270, 270.275, 270.280, 270.285, 270.290, 270.295, and 270.300, in Part 270 of the rules for Adult Protection and Advocacy Services under Title 89 of the Illinois Administrative Code. These amendments are being filed as a result of the expansion and transfer of authority to the Department for investigating allegations of abuse against adults with disabilities aged 18-59 living in domestic settings previously handled by the Office of the Inspector General for the Department of Human Services as a result of Public Act 98-49. Doing so will also help build a more integrated adult protection and advocacy system for outreach, intake, early intervention, and investigatory services at the local level and thereby improve responsiveness to reported incidents. These rules took immediate effect on December 31, 2013, and will run for a maximum of 150 days. This rulemaking project was published in the Illinois Register on page 2357 of Issue 3 in Volume 38 of the Illinois Register on January 17, 2014.

      NOTICE – Proposed amendments have been filed by the Department which affect Sections 270.10, 270.200, 270.205, 270.210, 270.215, 270.220, 270.225, 270.230, 270.235, 270.240, 270.241 (new), 270.245, 270.250, 270.255, 270.260, 270.265, 270.270, 270.275, 270.280, 270.285, 270.290, 270.295, and 270.300 in Part 270 for the rules governing Elder Rights under Title 89 of the Illinois Administrative Code. These amendments are not identical to the emergency rules currently in effect. This rulemaking project was published in the Illinois Register on page 2469 of Issue 4 in Volume 38 of the Illinois Register on January 24, 2014.
